The Lessor mentioned overleaf, hereafter referred to as “911 Rent A Car,” rents the vehicle identified overleaf to the Hirer. By signing, the Hirer acknowledges and agrees to be bound by the following terms and conditions:

 

  1. Delivery and Return

The vehicle is delivered to the Hirer in good overall condition without any apparent defects. Any complaints regarding the vehicle’s condition must be made to the Lessor immediately upon delivery. The Hirer agrees to return the vehicle with all documents and accessories, and in the same condition, to the Lessor at the specified location and date designated in this agreement. The Lessor reserves the right to repossess the vehicle at any time, without demand and at the Hirer’s expense, if the vehicle is used in violation of this agreement.

 

  1. Hirer Warranties and Undertakings
  2. i) Authorized Driver

The driver must have held a valid driving license for more than one year and be 25 years of age or older. The vehicle will only be driven by individuals whose names are registered on the rental agreement by the owner’s representative.

 

  1. ii) Prohibited Use

The Hirer shall not:

Use the vehicle for off-road driving, motorsports, towing, or any activities that may damage the vehicle. The Hirer is responsible for any damage due to misuse.

Use the vehicle to transport illegal substances (alcohol, drugs, etc.), merchandise, or passengers for hire, or for any other illegal activity. In the case of fines or confiscation of the vehicle, the Hirer is responsible for all related payments and damages to the Lessor, including the full value of the vehicle, fines, passenger claims, third-party claims, and loss of income or rental.

iii) Insurance Coverage Exclusions

No insurance coverage will be applicable if:

The Hirer or driver uses the vehicle without the Lessor’s consent.

The driver is under the influence of alcohol or drugs at the time of an accident.

The vehicle is driven by an unauthorized driver (refer to clause 2.i).

In such cases, the Hirer is liable for all damages to the vehicle, third-party expenses, passenger injuries, rental value for the total number of days the vehicle is under repair, and fines.

 

  1. iv) Traffic Rules and Regulations

The Hirer must observe all traffic rules and regulations and will be liable for any penalties arising from traffic offenses.

 

  1. v) Geographical Restrictions

The vehicle must not be taken outside the United Arab Emirates or into geographical areas restricted by the Lessor.

 

  1. Charges

The Hirer agrees to pay or reimburse the Lessor for:

 

  1. i) Rental Charges

Time and mileage charges are computed at the rates shown in this agreement or the current tariff at the start of the rental, subject to clause 1 above.

 

  1. ii) Additional Charges

Charges for refueling, Collision Damage Waiver (CDW), Personal Accident Insurance, Supplementary Insurance, and any standard or miscellaneous charges applicable at the rates shown in this agreement or current tariff.

 

iii) Collection Costs

The Lessor’s costs, including reasonable legal fees, incurred in collecting payments due from the Hirer under this agreement.

 

  1. iv) Fines and Penalties

Any fines, penalties, court costs, or other expenses imposed on the Lessor by law due to the vehicle’s use while rented to the Hirer, unless due to the Lessor’s fault. This does not relieve the Hirer or any other person of direct responsibility to government authorities for unlawful conduct.

 

  1. v) Repair Costs

The Lessor’s estimated repair costs, including towing and storage, limited to the maximum amount applicable to the vehicle tariff group (Deductible Amount) if the vehicle is damaged during the rental period.

 

  1. vi) Rental Period

One rental day is defined as 24 hours. Extra hours will be calculated as a full day. Removing the company’s sticker from the vehicle will incur a fine of fifty dirhams.

 

vii) Rate Adjustments

If no prior agreement has been made for weekly/monthly rates, the Hirer will be liable to pay the daily rates.

 

viii) Fuel Policy

The Hirer agrees to return the vehicle with the same level of fuel as noted in the vehicle check report. If the fuel level is not the same, 911 Rent A Car is authorized to charge the cost of the fuel plus a service charge to the Hirer’s credit card.

 

  1. ix) Early Return

If the Hirer agrees to a 3-day, 5-day, weekly, or monthly rental and returns the vehicle before the agreed period, daily rates will be charged.

 

  1. Indemnity to Lessor

The Hirer shall indemnify and hold the Lessor, its employees, and agents harmless from any loss, liability, and expenses arising directly or indirectly from:

 

  1. i) Breach of Agreement

Any breach of the terms of this agreement by the Hirer.

 

  1. ii) Loss or Damage

Loss or damage to the vehicle (except as provided in clause 5).

 

iii) Personal Injury

Death or injury to any person resulting from the operation or use of the vehicle.

 

  1. iv) Property Damage

Loss or damage to any property suffered by the Hirer or third parties arising from the operation or use of the vehicle, loss of the Hirer’s property left in the vehicle, or inconvenience resulting from delivery delays, breakdown, or causes beyond the Lessor’s control.

 

  1. v) Accident Recovery

The Hirer will bear the loss of time due to accidents until the car is driven out of the garage.

 

  1. vi) Vehicle Write-off

The Hirer will pay 30% of the vehicle value if the vehicle is written off due to an accident.

 

  1. Responsibility for Loss or Damage

The Hirer is liable for all loss or damage to the vehicle, including towing and storage, limited to the Deductible Amount.

 

  1. i) Collision Damage Waiver (CDW)

If the Hirer accepts the CDW on the front page and pays the supplementary fee, the Lessor will waive the Hirer’s responsibility for damage or loss to the vehicle, subject to any excess.

 

  1. ii) Return of Vehicle

The vehicle must be returned on or before the due date. In cases of extending or renewing the contract, a new rental agreement must be obtained. Insurance coverage ceases after the due date, and the Hirer will be held responsible for damages, losses, and other consequences arising from using the vehicle beyond the due date.

 

  1. Accidents and Thefts

In case of an accident (with or without vehicle damage) or personal injuries, the police must be called to the scene. The Hirer must obtain a police report. In case of theft, the Hirer must report it to the police, obtain a police report, and forward it to the Lessor. The Hirer must secure all data from other parties involved and witnesses to complete the accident report. Claims by third parties must be accepted by the Hirer. The Hirer is obliged to cooperate with the Lessor and its insurance company in all claims or legal matters related to an accident or damage.

 

No repairs are to be carried out on the vehicle without the prior approval of the Lessor. If any mechanical damage occurs, the Hirer should stop the vehicle and inform 911 Rent A Car immediately. Unauthorized repairs will make the Hirer liable for all costs.

 

  1. Insurance

The Lessor provides insurance coverage for persons using the vehicle with its permission (and not otherwise) under an automobile liability insurance policy, which is available for inspection.

 

  1. Personal Data

The Hirer acknowledges that personal data related to this rental agreement may be communicated to third parties, especially for credit protection purposes.

 

  1. Collision Damage Waiver

By initialling in the “Accept” space on the front page, the Hirer agrees to pay a supplementary fee according to the current valid price list. This waiver does not exempt the Hirer from liability in cases of gross negligence, deliberate violation of rental conditions, legal regulations, or insurance conditions.

 

  1. Personal Accident Cover

By initialling “Accept” on the front page, the Hirer agrees to pay additional fees as per the valid price list for personal accident coverage.

 

  1. Jurisdiction

This agreement shall be governed, construed, and interpreted in accordance with the laws of the United Arab Emirates.

 

  1. Language

In the event of a conflict between the terms of this agreement in English and any Arabic translation, the Arabic text shall prevail. However, the English text will be used to assist in interpretation.
